Agreement
By accessing this website or using an IceCapApps product, you agree to these terms and any product-specific terms presented to you. If you do not agree, do not use the applicable service. App stores, browsers, and third-party services may impose separate terms that also apply.
Who provides the services
IceCapApps is a business name of WCAP Detailing Inc., a Canadian corporation. References to “IceCapApps,” “we,” “us,” and “our” mean WCAP Detailing Inc. operating as IceCapApps.
Licence and acceptable use
Subject to these terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable licence to use our products for their intended purpose. You must comply with applicable law and must not:
- interfere with, disrupt, probe, or circumvent security or access controls;
- use a product to violate another person's privacy, intellectual property, or other rights;
- introduce malicious code, automate abusive requests, or place unreasonable load on a service;
- copy, resell, sublicense, or reverse engineer a product except where applicable law expressly permits it; or
- misrepresent your relationship with IceCapApps or use our marks without permission.
Your content and third-party services
You remain responsible for content you enter, upload, or send and for ensuring you have the right to use it. PromptTidy operates within independent third-party chat services. Those services receive content when you choose to send it and govern that content under their own terms and privacy policies. We do not control their availability, responses, or data practices.
Experimental services
Features labelled “experiment,” “demo,” “preview,” or similar are provided for evaluation and may change, produce inaccurate results, stop working, or be withdrawn without notice. Virtual Fitting images are visual simulations, not guarantees of fit, size, colour, texture, availability, or how an item will look in person. Do not rely on a simulation as the sole basis for a purchase or other important decision.
Ownership
IceCapApps products, software, visual identity, site content, and related intellectual property are owned by us or our licensors. These terms do not transfer ownership. Third-party names and marks belong to their respective owners; their appearance does not imply sponsorship or endorsement.
Availability and changes
We may maintain, modify, suspend, or discontinue a product or feature. We do not promise uninterrupted or error-free operation, continued compatibility with third-party platforms, or permanent availability of free services. Where reasonably practicable, we will avoid changes that unfairly affect rights already acquired.
Disclaimers
To the fullest extent permitted by law, the website, products, and demos are provided “as is” and “as available,” without warranties or conditions not expressly stated here. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing in these terms excludes a warranty or consumer right that cannot lawfully be excluded.
Limitation of liability
To the fullest extent permitted by law, IceCapApps and WCAP Detailing Inc. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities arising from use of—or inability to use—the services. Our aggregate liability for a claim will not exceed the greater of the amount you paid us for the affected service during the preceding 12 months and CAD $100. These limits do not apply where prohibited by law or to liability that cannot lawfully be limited.
Indemnity
To the extent permitted by law, you agree to indemnify WCAP Detailing Inc. against third-party claims and reasonable costs arising from your unlawful use of a service, your content, or your material breach of these terms. This section does not require a consumer to indemnify us for our own negligence or unlawful conduct.
Suspension and termination
You may stop using a service at any time. We may suspend or terminate access where reasonably necessary to protect users, comply with law, address abuse or security risk, or respond to a material breach. Provisions that by their nature should survive termination—including ownership, disclaimers, and liability limits—will survive.
Governing law
These terms are governed by the laws of Nova Scotia and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Courts located in Nova Scotia will have non-exclusive jurisdiction. Mandatory consumer protections and rights to bring a claim elsewhere remain unaffected.
Changes and contact
We may revise these terms to reflect legal, security, or product changes. The date above identifies the latest version. Material changes apply prospectively unless law requires otherwise. Questions may be sent to apps@icecapapps.com.
